Kaplan Fox Announces First Circuit’s Denial Of Defendants’ Petition For An Appeal Of The Class Certification Order In Credit Suisse-AOL Securities Litigation

On January 8, 2009, the United States Court of Appeals for the First Circuit denied the petition of Defendants Credit Suisse First Boston, Frank Quattrone, Elliott Rogers, James Kiggen and Laura Martin (“Defendants”) for an appeal of the class certification order entered by the District of Massachusetts on September 26, 2008 in the matter of In re Credit Suisse-AOL Securities Litigation, 1:02 CV 12146.  In this matter, shareholders of Time Warner (formerly AOL Time Warner) (“Plaintiffs”), allege that Defendants misrepresented and omitted material information concerning AOL Time Warner in their analyst reports from January 12, 2001 through July 24, 2002. 

The Plaintiff class includes all persons who purchased the common stock of AOL Time Warner from January 12, 2001 through July 24, 2002, inclusive.  If you believe you are a member of the class, you need not take any action at this time.
