Kaplan Fox and its’ co-counsel represent several large direct purchasers of sodium hydroxide, (commonly known as caustic soda) in civil antitrust litigation against several leading chemical manufacturers who have conspired to artificially inflate the price of sodium hydroxide dating back to at least October 1, 2015.
Defendants, including, Olin Corporation., Occidental Chemical Corporation., Westlake Chemical Corporation., Shin-Etsu Chemical Company., and Formosa Plastics Corporation, control at least 90 percent of the domestic supply of the U.S. caustic soda market. The alleged conspiracy was facilitated by secret co-producer supply agreements; by exchange of nonpublic, commercially sensitive information; by manipulation of price index; and, among other things, by the characteristics of the industry.
